The merchant site www.mizensir.ch (hereinafter referred to as the "Site") is an e-commerce site accessible via the Internet and is published by the Company Mizensir SA, whose registered office is located at Chemin de la Pallanterie 11, 1252 Meinier, Switzerland.

Version in force as of January 1, 2020 applying to the site accessible at the URL address www.mizensir.ch (hereinafter “the Site”).

The purpose of these general conditions of use (hereinafter "GTU") is to set the conditions for access to the Site and use of the services offered on the Site. The T&Cs apply to any variation or extension of the Site on existing or future social and/or community networks.

Any adult having access to the Site, regardless of their status (individual or professional), the place where they are located, the methods of connection to the Site, the object and purpose of their access to the Site and/or use of the services, is a user (“the User”).

Article 1 – Acceptance of the T&Cs

The User is presumed to know and accept, without reservation, all of the T&Cs simply by connecting to the Site, regardless of the digital reception terminals used.

If the User does not accept all or part of the documents referred to above, he must stop using the Site.

The models represented on the Site are protected by copyright and following of the Intellectual Property Code relating to the protection of registered models.

Reproductions, on paper or computer, of the said Site and of the works and models reproduced therein are authorized provided that they are strictly reserved for personal use excluding any use for advertising and/or commercial purposes and /or information and/or that they comply with the provisions of article L. 122-5 of the Intellectual Property Code.

With the exception of the above provisions, any reproduction, representation, use or modification, by any process whatsoever and on any medium whatsoever, of all or part of the Site, of all or part of the various works and models that compose it, without having obtained the prior authorization of Mizensir, is strictly prohibited and constitutes an offense of counterfeiting.

2.2 Trademark Law

The Mizensir, MIZENSIR GENEVE, MIZENSIR PARFUMS and mizensir.ch names and logos, and the products and services associated therewith, are protected trademarks.

Other brands are also mentioned. They are used by Mizensir either with the authorization of their holder, or as a simple indication of the products or services offered.

The reproduction, imitation, use or affixing of these marks without having obtained the prior authorization of Mizensir or their respective owners constitutes an offense of counterfeiting.

Article 3 - Newsletters

3.1 Mizensir offers Users the option of subscribing to newsletters published by Mizensir (hereinafter the "Newsletter").

3.2 The User may at any time unsubscribe from these Newsletters using the unsubscribe link at the bottom of each Newsletter sent.

Mizensir respects the privacy rights of Site visitors and recognizes the importance of protecting the data collected about them.

Article 6 – Information on products and services

6.1 Mizensir reserves the right to modify the information appearing on the Site, in particular relating to the technical characteristics and the articles and models presented, at any time, without notice, taking into account the interactivity of the Site, without this being able to engage the responsibility of Mizensir or its employees.

6.2 Access to the products and services presented on the Site may be subject to restrictions. The user must ensure that the law of the country from which the connection is established authorizes him to access the Site.

Article 7 – Limitation of liability

7.1 The User uses the Site at his own risk.

7.2 Under no circumstances can Mizensir, its subsidiaries or the members of its network be held liable for direct or indirect damage, and in particular material damage, loss of data or program, financial loss, resulting from access to or use of this Site or any sites linked to it.

Article 8 – Applicable law

The T&Cs are subject to Swiss domestic law and in the event of a dispute, the Swiss courts will have sole jurisdiction.
